Company context as intellectual property: write it down and keep it

Company context is written-down, verified knowledge about the company (facts, rules, examples and constraints), selected for a task and used by people and AI. A knowledge base is the place where those sources are stored. When the company controls sources, access and exports, its knowledge stays with it after a change of model or provider.

What company context contains

A knowledge base stores documents and facts. Context selects from them what a specific task needs: who we are answering, what we can promise, which evidence we use and who makes the decision. Preparing a proposal requires a different subset than answering an employee.

Daniel Siwek, founder of SyncGrowth (a Warsaw company that helps design and implement better ways of working), presented this structure on 5 August 2026 at Środa Dzień Bloga, a Warsaw meetup for marketers and content creators. The starting point: according to the Stanford AI Index 2025, the lead of the best closed model over the best open model fell from 8.04% to 1.70% in a year (Chatbot Arena, January 2024 to February 2025), so choosing a model gives a shrinking advantage. Context decides the difference, as a document with four parts. The same structure can support communication and a repeatable workflow.

  • Rules: brand language or workflow steps that must not be skipped.
  • Facts and figures: current information, its source and an owner.
  • Examples: approved copy, decisions or ways to handle exceptions.
  • Constraints: what must not be published or promised, and when to hand over to a person.

Why context is a company asset and what ownership means

Documented knowledge can support employee onboarding, content, sales and an assistant. Its value comes from company experience and the connections between facts.

Here, intellectual property describes the value of organised know-how. Not every fact or document automatically receives the same legal protection. Agreements need to address material rights, confidentiality, licences and reuse. Third-party materials require a separate check.

Polish law offers two forms of protection here. The first is the trade secret (Article 11(2) of the Act on Combating Unfair Competition): information of economic value that is not generally known, provided the company took steps to keep it confidential. The second is database protection (Act of 27 July 2001 on the Protection of Databases): a collection of data arranged by a systematic method whose preparation, verification or presentation required a substantial investment. A context document may meet these conditions, but it does not have to. Leave the assessment of a specific case to a lawyer.

Write it down, trim it, use it

Start with one task. Describe how work actually happens, including exceptions and information sources. Remove material that does not affect a decision or outcome. Use the document in the task and check where a person or model still has to guess.

These are the presentation's three steps: record reality, trim unnecessary material and use it every time. A complex system is not required at the start. A short document lets you check the structure before choosing a tool.

Keep the knowledge, change the tools

Keep sources and rules in a company-controlled location. Separate them from a chat tool's settings, agent instructions and a technical search index. An index can be rebuilt from sources when exports include documents, metadata and relationships.

Before implementation, agree on export formats, administrator access and exit terms. Moving documents does not guarantee identical answers from another model. After a tool change, recheck quality, permissions and source references.

Maintenance: ownership, change and review

Each knowledge area needs an owner. A product change, completed project or new decision enters an update queue. An accountable person confirms the source, effective date, access level and which earlier entry is replaced.

Illustrative fact record: content, source, owner, confirmation date, access scope and next review date. This is a structure example without client data. Mark outdated information as superseded so an assistant does not treat both versions as current.

A knowledge base stores sources. Context selects facts, rules, examples and constraints for a task. Both layers may use the same documents.

Can a company keep its context when changing AI providers?

It can if it controls documents, access and exports and its agreement permits reuse. Settings inside a closed tool do not replace a company-owned copy of the sources.

Is all company context legally protected intellectual property?
